Terms of Service

1. Acceptance of Terms

By creating an account on or accessing Band Artist Booking ("the Platform", "we", "us", "our"), you ("User", "you", "your") accept and agree to be bound by these Terms of Service, our Privacy Policy, and our Refund Policy. If you do not agree to these terms, you must not use the Platform.

You must be at least 16 years of age to use this Platform. By registering, you confirm that you meet this age requirement.

2. Description of Service

Band Artist Booking is a platform that connects musicians, artists, and bands with venues, event organizers, and each other. The Platform provides tools for managing bookings, showcasing artist profiles, facilitating communication, and sharing gig content.

3. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your password and account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that all information you provide is truthful and up to date

Providing false, misleading, or fraudulent information constitutes a breach of these Terms and may result in immediate account termination.

4. Subscriptions and Payments

Certain features of the Platform require a paid subscription. Subscriptions are billed on a recurring basis (monthly or yearly) and are processed through LemonSqueezy, our third-party payment processor.

  • By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel
  • You may cancel your subscription at any time through your account settings
  • Upon cancellation, you retain access until the end of your current billing period
  • No pro-rated refunds will be issued for unused subscription time except as described in our Refund Policy

4.1 Price Changes

We reserve the right to change subscription prices at any time. When we do:

  • We will notify you by email at least 30 days before any price increase takes effect
  • The notification will include the new price, the effective date, and your options
  • Price changes apply to your next billing cycle on or after the effective date
  • If you do not agree with a price change, you may cancel your subscription before the effective date and retain access until the end of your current billing period
  • Continuing to use the Platform after a price change takes effect constitutes acceptance of the new price

5. Content Ownership and License

You retain full ownership of all content you upload to the Platform, including but not limited to profile photos, gig images, audio recordings, videos, and text ("User Content").

By uploading User Content, you grant Band Artist Booking a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your content solely in connection with operating and promoting the Platform. This includes displaying your profile in search results, the public feed, within the app, and on affiliated websites operated by Band Artist Booking (such as bendzavencanja.com, bendzaveselja.com, bendzarodjendan.com, bendzakrstenja.com, bendzaproslave.com, bendzaevent.com, and any future partner domains). These affiliated websites display your publicly available profile information to help you reach a wider audience of potential clients.

6. Marketing Use of Profiles and Content

If you have provided explicit marketing consent during registration or through your account settings, we may use your public profile information, uploaded images, and gig content for promotional and marketing purposes, including but not limited to:

  • Social media posts showcasing artists and events on the Platform
  • Promotional emails and newsletters featuring Platform content
  • Advertising materials for the Platform (online and offline)
  • App Store and Google Play Store screenshots and marketing materials
  • Press releases and media coverage

This marketing consent is entirely optional and separate from your acceptance of these Terms. You may withdraw your marketing consent at any time through your account settings without affecting your use of the Platform. Upon withdrawal, we will cease using your content for new marketing materials, though existing published materials may remain in circulation.

7. Prohibited Conduct and Content Standards

Band Artist Booking maintains a zero-tolerance policy for objectionable content and abusive users. Any user found posting objectionable content or engaging in abusive behavior will have their content removed and their account permanently suspended. We actively review all reports and take action within 24 hours.

You agree not to use the Platform to:

  • Violate any applicable local, national, or international laws or regulations
  • Infringe upon the intellectual property rights of others
  • Harass, abuse, threaten, bully, stalk, or intimidate other users, whether in public comments, private messages, or any other part of the Platform
  • Submit false, misleading, or fraudulent information or booking requests
  • Impersonate another person or entity
  • Interfere with or disrupt the Platform's infrastructure or security
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use the Platform for spam, unsolicited advertising, or phishing
  • Scrape, crawl, or harvest data from the Platform without authorization
  • Create multiple accounts to circumvent bans or restrictions

7.1 Content Standards

All content you upload, post, or share on the Platform — including profile images, gig photos, videos, audio recordings, comments, messages, bios, and any other user-generated content — must comply with the following standards. You may not upload or share content that:

  • Nudity and sexual content: Contains nudity, sexually explicit material, pornographic imagery, or sexually suggestive content. This includes profile photos, gig post images, and any media shared through the Platform.
  • Violence and graphic content: Depicts graphic violence, gore, mutilation, animal cruelty, or content that glorifies or incites violence against any person or group.
  • Hate speech and discrimination: Promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic.
  • Profanity and abusive language: Contains excessive profanity, slurs, insults, or abusive language directed at other users in comments, messages, reviews, or public posts. Artistic expression in song lyrics or performance content is permitted within reason, but personal attacks on other users are never acceptable.
  • Bullying and targeted harassment: Targets specific individuals with repeated unwanted contact, personal attacks, public shaming, doxxing (sharing private information), or coordinated campaigns to intimidate or silence them.
  • Defamation and misinformation: Contains false statements presented as fact that damage the reputation of individuals, businesses, or organizations.
  • Illegal activity: Promotes or facilitates illegal activities, including drug use or trafficking, weapons sales, or any other unlawful conduct.
  • Self-harm: Promotes, glorifies, or provides instructions for self-harm or suicide.
  • Spam and misleading content: Consists of repetitive, irrelevant, or misleading content posted to artificially inflate engagement or deceive other users.

7.2 Enforcement

We review reported content and may take any of the following actions at our sole discretion:

  • Remove or hide the offending content without notice
  • Issue a formal warning to the user
  • Temporarily suspend the user's account
  • Permanently terminate the user's account without refund (see Section 12)
  • Report the content or user to relevant law enforcement authorities where required by law

We encourage users to report violations using the reporting features available on the Platform or by contacting us through our contact page. All reports are reviewed confidentially.

8. Platform Intellectual Property

The Platform — including its source code, object code, software, algorithms, user interface design, layout, visual elements, logos, trademarks, trade names, service marks, domain names, graphics, icons, and all associated documentation and materials — is the exclusive property of Band Artist Booking and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in the Platform itself or any of its components beyond the limited, non-exclusive, non-transferable, revocable right to access and use the Platform in accordance with these Terms. All rights not expressly granted herein are reserved by Band Artist Booking.

  • The Band Artist Booking name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use them without our prior written permission.
  • Any feedback, suggestions, or ideas you submit to us about the Platform may be used by us without restriction or compensation to you.

9. Reverse Engineering and Restrictions

You agree that you will not, and will not permit any third party to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying ideas, algorithms, or structure of the Platform or any part thereof
  • Modify, adapt, translate, or create derivative works based on the Platform or its software
  • Copy, reproduce, distribute, republish, or mirror any portion of the Platform without express written consent
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices on or within the Platform
  • Bypass, disable, or circumvent any security features, access controls, usage limits, or technical protection measures of the Platform
  • Probe, scan, or test the vulnerability of the Platform or breach any security or authentication measures
  • Use any technique to fingerprint, benchmark, or extract the architecture or configuration of the Platform's infrastructure

Violation of this section constitutes a material breach of these Terms and may result in immediate account termination, legal action, and claims for damages.

10. Automated Access and Anti-Scraping

You may not access the Platform through automated means, including but not limited to:

  • Web scrapers, crawlers, spiders, bots, or any automated data collection or extraction tools
  • Scripts or software that send requests to the Platform at a rate that exceeds what a human user could reasonably generate
  • Any tool, script, or process designed to harvest, mine, or systematically collect user profiles, contact information, images, audio, or any other data from the Platform
  • Automated account creation, login attempts, or credential stuffing
  • Using the Platform's API (if made available) in ways not explicitly authorized or beyond the documented rate limits

We reserve the right to implement technical measures to detect and block automated access, including rate limiting, CAPTCHAs, IP blocking, and behavioral analysis. Any attempt to circumvent these measures is a violation of these Terms.

Data collected from the Platform may not be used to build, train, or improve any competing product, service, machine learning model, or dataset without our express written consent.

This section does not apply to recognized search engine crawlers (such as Googlebot, Bingbot, and similar) that access publicly available pages in compliance with our robots.txt file and standard web crawling protocols.

11. Force Majeure

Band Artist Booking shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, epidemics, pandemics, or acts of God
  • War, terrorism, civil unrest, or government actions
  • Internet or telecommunications failures, cyberattacks, or DDoS attacks
  • Failures of third-party service providers (hosting, payment processors, email providers)
  • Power outages, equipment failures, or infrastructure disruptions
  • Changes in applicable laws or regulations that affect our ability to provide the service

In such cases, our obligations will be suspended for the duration of the event. We will make reasonable efforts to notify users and resume service as soon as practicable.

12. Account Suspension and Termination

We reserve the right to suspend or permanently terminate your account, without prior notice, if we determine, at our sole discretion, that you have violated these Terms of Service. Grounds for suspension or termination include, but are not limited to:

  • Engaging in any prohibited conduct listed in Sections 7, 9, or 10
  • Repeated violations of community guidelines
  • Fraudulent or abusive behavior toward other users
  • Providing false identity or account information
  • Attempting to circumvent a previous ban
  • Any activity that we reasonably believe harms the Platform or its users

Upon account termination for a valid violation of these Terms, you forfeit all rights to any active subscription, paid features, or credits. No refund will be issued for accounts terminated due to Terms of Service violations. See our Refund Policy for full details.

You may appeal a ban by contacting us through our contact page. Appeals will be reviewed on a case-by-case basis.

13. Account Deletion

You may delete your account at any time through your account settings. Upon deletion:

  • Your personal data will be permanently deleted in accordance with our Privacy Policy
  • Your public profile, gig posts, and uploaded content will be removed
  • Bands you own will be transferred to the next member or deleted
  • Your messages will be removed from conversations
  • This action is irreversible

14. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free. We are not responsible for the conduct of users, the accuracy of user-submitted content, or the outcome of bookings arranged through the Platform.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Band Artist Booking and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to lost profits, data loss, or damages resulting from bookings.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless Band Artist Booking from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Belgrade, Serbia.

For users within the European Union, nothing in these Terms affects your rights under applicable EU consumer protection laws, including the GDPR.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email at least 30 days before taking effect. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Platform and delete your account.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court, the remaining provisions shall remain in full force and effect.
